These Terms & Conditions ("Terms") govern your access to and use of the Mambobaby website, online store, products, content, features, tools, and related services (the "Services"). The terms "Mambobaby," "we," "us," and "our" refer to:

Our online store is powered by Shopify. Mambobaby products are manufactured by Zhejiang Mambobaby Baby Products Co., Ltd. (owner of the Mambobaby trademark); Mambobaby Inc is the authorized U.S. seller. By accessing the Services, creating an account, or placing an order, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, please do not use the Services. These Terms contain important provisions concerning product safety, warranties, limitations of liability, governing law, and dispute resolution.

1. Eligibility and Accounts

You must be at least the age of majority in your jurisdiction to create an account or place an order. If you allow a minor to use the Services through your device or account, you are responsible for supervising that use. You agree to provide accurate, current, and complete information, to keep your account credentials confidential, to be responsible for activity under your account, and to notify us promptly of any unauthorized access. You may not sell, transfer, assign, or license your account.

2. Product Information

We make reasonable efforts to display and describe products accurately. Colors, materials, dimensions, patterns, packaging, and appearance may vary slightly due to screen settings, lighting and photography, manufacturing tolerances, and product or packaging updates. Descriptions, features, specifications, prices, and availability may change over time; such changes will not retroactively alter an accepted order except to correct an error or as permitted by law. We may discontinue products or limit quantities based on availability, geographic restrictions, suspected fraud, unauthorized resale, or other legitimate reasons. Age, weight, height, sizing, and intended-use guidance may differ between products — always review the product page, packaging, instructions, and warnings before use.

3. Orders and Acceptance

Submitting an order is an offer to purchase. An automated confirmation email confirms receipt only; unless we state otherwise, an order is accepted when we send a shipping confirmation. We may reject, limit, or cancel an order for legitimate reasons, including product unavailability, pricing or listing errors, payment problems, shipping restrictions, or suspected fraud or unauthorized resale. If we cancel after collecting payment, we refund the applicable amount to the original payment method. Products purchased through the consumer storefront are for personal or household use and not for unauthorized commercial resale or export; this does not apply to purchases under an authorized Mambobaby wholesale, retailer, or distribution agreement.

4. Prices, Promotions, and Payment

The price charged is the price shown at checkout when the order is placed, subject to correction of obvious errors as permitted by law. Taxes, shipping charges, customs duties, brokerage fees, and import charges may apply and are shown or described at checkout where available. Prices may differ between our website and third-party retailers or marketplaces. Promotions may have separate terms, and discounts cannot be combined unless stated. By submitting payment information, you confirm it is accurate, that you are authorized to use the method, and that you authorize us and our payment providers to charge the total shown. See our Payment Policy.

5. Shipping and Delivery

Processing and delivery estimates are in our Shipping Policy. Delivery dates are estimates unless expressly guaranteed and may be affected by carriers, customs, weather, holidays, service interruptions, incorrect address information, or other circumstances outside our reasonable control. You are responsible for providing a complete, accurate delivery address; additional charges may apply for redirection or reshipment due to an incorrect address. Risk of loss passes to you on delivery to the address provided, except where law requires otherwise. If an order arrives damaged, defective, incomplete, or incorrect — or tracking shows delivery but you cannot locate the package — contact us promptly.

6. Returns, Cancellations, and Refunds

Returns, exchanges, and refunds are governed by our Return & Refund Policy, and cancellations by our Order Cancellation Policy. Nothing in these Terms limits any return, cancellation, warranty, or refund right that cannot legally be limited under applicable consumer-protection law.

7. Product Safety and Proper Use

Products intended for children must be used only under appropriate adult supervision and in accordance with all product-specific instructions and warnings. Before every use: inspect the product and components; confirm it is correctly assembled and adjusted; follow the stated age, weight, height, and sizing guidance; and stop using it if it is damaged, excessively worn, incorrectly assembled, missing a component, or otherwise unsuitable.

Float and water products. Mambobaby flotation products are not lifesaving devices, are not a substitute for competent adult supervision, and are not certified personal flotation devices unless expressly identified as such. Children must remain under constant, close, attentive adult supervision whenever they are in or around water, and a responsible adult must remain within arm's reach during use. Never leave a child unattended in or around water, even for a moment.

Guard products. Mambobaby Guard products must be used only for the purposes in their instructions. Unless expressly stated, they are not certified protective helmets and must not be used for cycling, motorized activities, sports, high-speed activities, or any activity requiring certified head protection. They do not replace caregiver supervision.

Rider products. Mambobaby Rider products must be used within their model-specific age, height, weight, speed, and environmental limits. Unless expressly permitted, they must not be used on public roads or in traffic, on stairs or steep slopes, on wet, uneven, or hazardous surfaces, or outside the environments specified. A responsible adult must supervise use.

To the fullest extent permitted by law, we are not responsible for loss or injury caused by failure to follow instructions or warnings, failure to supervise, use outside the stated range, use for an unintended purpose, use in an unsuitable environment, or continued use of a damaged, modified, or improperly maintained product. Nothing here excludes responsibility for a defective product or any liability or consumer right that cannot lawfully be excluded. If product information appears inconsistent or unclear, stop using the product and contact us.

8. Intellectual Property

The Services and their content — including trademarks, brand names, text, graphics, photographs, product images, illustrations, videos, audio, software, and page design — are owned by or licensed to Mambobaby Inc and the Mambobaby brand owner, Zhejiang Mambobaby Baby Products Co., Ltd., and are protected by applicable intellectual-property laws. You may access the Services for personal, non-commercial use. Unless permitted by law or authorized by us in writing, you may not reproduce, modify, distribute, publish, display, sell, license, transmit, scrape, or commercially exploit any part of the Services. Shopify's names, logos, and marks belong to Shopify; other third-party marks belong to their respective owners.

9. Third-Party Services and Links

The Services may contain links, embedded features, or tools operated by third parties. We do not control and are not responsible for their availability, security, content, policies, or practices. Review a third-party service's terms and privacy policy before using it; your use is governed by your relationship with that provider.

10. Relationship With Shopify

Shopify provides the e-commerce platform used to operate our store. Purchases are transactions directly between you and Mambobaby Inc. To the extent permitted by law, Shopify is not responsible for products sold by Mambobaby Inc or for claims arising solely from transactions between you and Mambobaby Inc. Nothing here limits a right or remedy that cannot legally be waived.

11. Privacy

We process personal information as described in our Privacy Policy. Because Shopify hosts the store, Shopify may process information relating to your use of the Services. Depending on your location, you may have the right to opt out of certain uses or sharing through our Your Privacy Choices page.

12. Reviews, Feedback, and User Content

You may submit reviews, comments, photos, videos, or other content through public review features or designated channels. You retain ownership of your content; by submitting it for public display, you grant Mambobaby Inc a non-exclusive, worldwide, royalty-free, transferable, and sublicensable license to use, reproduce, adapt, publish, display, and distribute it in connection with operating, improving, and promoting Mambobaby. You confirm that you own or have permission to provide the content, that it does not violate another person's rights, that it is truthful and not misleading, and that you have disclosed any material connection where required by law. Content provided privately for support (such as defect photos) will not be used in public marketing without additional permission. We may refuse, edit, or remove content we reasonably believe is unlawful, infringing, deceptive, or otherwise inconsistent with these Terms.

13. Errors and Availability

The Services may occasionally contain errors in descriptions, specifications, prices, promotions, shipping charges, delivery estimates, or availability. We may correct these and update information. If an error materially affects an order before acceptance, we may contact you for confirmation or cancel the affected order and refund any amount collected. We will not increase the price of an accepted order without your agreement, except where required by law.

14. Prohibited Uses

You may use the Services only for lawful purposes. You must not violate applicable law or another party's rights; submit false or misleading information; impersonate another person or entity; upload viruses or malicious code; interfere with the security or operation of the Services; collect personal information without authorization; send spam; bypass access controls, CAPTCHAs, rate limits, or security measures; use automated tools to extract data in violation of our instructions or the law; or copy, resell, or commercially exploit the Services without authorization. We may restrict or block automated access that creates security, operational, legal, or excessive-resource risks.

15. Suspension and Termination

You may stop using the Services at any time. We may suspend or terminate access if we reasonably believe you violated these Terms, used the Services unlawfully, created a fraud or security risk, or engaged in conduct that could harm us, our customers, Shopify, or other users. Where required by law, we will provide appropriate notice. Termination does not affect rights or obligations that arose beforehand, and provisions that by their nature should continue will survive.

16. Disclaimer of Warranties

Product information on the Services is provided for general information and does not replace product labels, instructions, warnings, professional advice, water-safety guidance, or responsible adult supervision. Except as expressly stated by Mambobaby Inc or required by law, the Services are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim implied warranties concerning the Services, including merchantability, fitness for a particular purpose, title, and non-infringement, and we do not guarantee the website will always be uninterrupted, secure, timely, or error-free. Nothing here excludes a warranty, guarantee, right, or remedy that cannot lawfully be excluded.

17. Limitation of Liability

To the fullest extent permitted by law, Mambobaby Inc and its affiliates, officers, directors, employees, agents, contractors, service providers, and licensors will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from use of the Services. Some jurisdictions do not allow certain exclusions or limitations; in those, liability is limited only to the maximum extent permitted by law. Nothing excludes or limits liability that cannot legally be excluded, including for fraud, willful misconduct, gross negligence, defective products, or personal injury where such limitation is prohibited.

18. Indemnification

To the extent permitted by law, you agree to indemnify Mambobaby Inc against third-party claims, losses, liabilities, and reasonable legal costs arising directly from your material breach of these Terms, your unlawful use of the Services, your violation of another party's rights, or content you submit that infringes another party's rights. This does not apply to claims caused by our own unlawful conduct, negligence, defective products, or breach of these Terms.

19. General Terms

Severability. If any provision is found unlawful or unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will continue in effect. No waiver. Our failure to enforce a provision does not waive our right to enforce it later. Entire agreement. These Terms, together with our posted policies and any product- or promotion-specific terms, form the agreement between you and Mambobaby Inc concerning the Services. Assignment. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, reorganization, financing, sale of assets, or transfer of the Services, subject to law.

Governing law and jurisdiction. These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles. Subject to any mandatory consumer protections available where you reside, disputes will be subject to the state or federal courts located in Denver, Colorado. Nothing in this section deprives a consumer of protections that cannot legally be waived.

Changes. We may update these Terms by posting the revised version and updating the "Last updated" date. Material changes apply prospectively unless law permits otherwise, and where legally required we will provide additional notice before material changes take effect.
